Terms of Service

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE AQUAVITA MOBILE APPLICATION ("APP"). BY ACCESSING OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APP.

1. MEDICAL DISCLAIMER (NOT A MEDICAL DEVICE)

AQUAVITA IS NOT A MEDICAL PROVIDER. The App, its AI-assisted food estimate features, and Water Balance Index (WBI) calculations are provided for general wellness, informational, educational, and habit-building purposes only.

  • No Medical Advice: The information provided by the App does not constitute medical advice, diagnosis, treatment, cure, or prevention of any condition.
  • Consult a Professional: Always seek the advice of a qualified physician or healthcare provider with questions about a medical condition, diet, hydration levels, or the reminders you set.
  • Emergency Situations: Never use AquaVita in a medical emergency. If you believe you have a health emergency, call local emergency services immediately.

2. LIMITATION OF LIABILITY & USER RESPONSIBILITY

By using AquaVita, you acknowledge and agree that:

  • Minimum Age: AquaVita is intended for users aged 16 or older.
  • Personal Risk: All actions taken based on the App's notifications, visual status, or general guidance are performed at your own risk.
  • Estimates Only: AquaVita's hydration calculations, WBI, food recognition, calories, and nutrient values are estimates and are not exact measurements.
  • Verification Obligation: You are responsible for reviewing and correcting any food, drink, task reminder, or profile data before saving or relying on it.
  • Task Reminders: Task reminders are manual reminders and journal entries only and are not advice of any kind. AquaVita does not provide dosage advice, interaction checks, warnings, or hydration requirements, and does not validate, interpret, or check the entries or schedules you enter.
  • Today's Activity Boost: Today's Activity boost is an optional user-selected estimate that may increase today's hydration target only. It is not medical advice, does not determine a required intake, does not affect calorie guidance, and should be adjusted or ignored based on your own judgment and professional guidance.

3. AI-ASSISTED FOOD ESTIMATES AND THE WBI ALGORITHM

When AI food scanning is used, AquaVita may send food photos or food images to Gemini for estimated food recognition and nutrition estimates.

  • AI Fallibility: AI can provide incorrect classifications or estimates. You must review and correct AI-assisted results before saving them.
  • Dynamic Nature: App calculations, including WBI, are based on general wellness models and may not account for your specific medical needs or underlying health conditions.

4. DATA COLLECTION & PRIVACY

Details of how data is handled are described in our Privacy Policy, available in the App. In summary, to provide the current app experience, AquaVita collects and processes data:

  • Camera & Photos: AquaVita uses the camera and selected photos for food photo estimates, barcode scanning, and profile photos. Food photos or images may be sent to Gemini when you use AI food scanning.
  • Food Lookups: Manual food search uses local food results. Barcode lookup may send barcode values to Open Food Facts.
  • Task Reminders: Task reminders are created manually from the information you enter, such as name, note, reminder times, active or paused state, and done logs.
  • Hydration Estimates: AquaVita estimates your daily hydration target on device from your profile, digestion, sleep, and optional Today's Activity boost. The current app does not use the date, external weather, device health, or device position integrations.
  • Personal Data: Profile details such as weight, height, age, and gender are used for on-device app calculations and personalization and are stored only on your device in an encrypted database.
  • Diagnostics & Feedback: Anonymous crash diagnostics and the feedback messages you choose to send are the only other data that leave your device.
  • Data Security: We use encryption and do not sell your personal app data to third-party advertisers.

5. ACCOUNTS

An account is optional. You can use AquaVita as a guest. You may create an account (Google or Apple) at any time. You can delete your account and all associated data from within the App (Profile → About AquaVita → Delete account); deletion is permanent and cannot be undone.

6. SUBSCRIPTIONS AND PAYMENTS

Some features require an AquaVita PRO auto-renewing subscription.

  • Billing: Payment is charged to your Apple App Store or Google Play account at confirmation of purchase. Prices are shown at checkout in your local currency.
  • Auto-Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
  • Cancellation: You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Uninstalling the App does not cancel a subscription.
  • Free Trial: If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Trial terms are shown before you subscribe.
  • Refunds: Refunds are handled by Apple or Google under their respective store policies.

7. THIRD-PARTY SERVICES

AquaVita may interact with third-party services used by the current app, including Firebase, RevenueCat, Gemini for AI food estimates when used, and Open Food Facts for barcode lookup. Barcode lookup may send barcode values to Open Food Facts. Manual food search uses local food results. We are not liable for inaccuracies, outages, or changes in data provided by these services.

8. NO WARRANTY (PROVIDED "AS IS")

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

9. CHANGES TO SERVICES

AquaVita reserves the right to modify or discontinue any feature at any time without prior notice.

10. INDEMNIFICATION

You agree to indemnify and hold harmless AquaVita, its developers, and affiliates from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.

11. CHANGES TO THESE TERMS

We may update these Terms from time to time. If we make material changes, the App will ask you to review and accept the updated Terms before continued use.

12. MEDICAL CONFLICT & PROFESSIONAL GUIDANCE

In the event of any conflict between information provided by the App and advice from a licensed medical professional, the medical professional's advice must always take precedence.

  • No Critical Reliance: You shall not rely on the App for health-critical decisions.
  • Active Verification: You are responsible for comparing App data with your real-world circumstances and professional guidance.
  • Non-Intervention: AquaVita is not designed to override any medical treatment plan.
